1. Services
1.1 Custom Jewelry Design: Evermade Design, LLC specializes in creating custom jewelry pieces according to the client's specifications. Our team of skilled designers and bench masters will work closely with you to bring your unique vision to life.
1.2 Design Consultation: We offer design consultations to understand your preferences, discuss design ideas, and provide guidance. The consultation may take place in person, via phone, or through online communication channels.
1.3 Materials and Gemstones: We source high-quality materials and gemstones for our jewelry designs. However, the availability of specific materials and gemstones may vary and is subject to market availability.
2. Ordering Process
2.1 Design Concept: During the design consultation, we will collaborate with you to develop a design concept based on your preferences. This concept will serve as the foundation for creating your custom jewelry piece.
2.2 Quotation: Upon finalizing the design concept, we will provide you with a quotation for the cost of materials, labor, and any additional services requested.
2.3 Deposit and Payment: To initiate the design process, a non-refundable deposit may be required, as specified in the quotation. Full payment must be made before the production of the custom jewelry piece.
2.4 Design Approval: Once the design concept and quotation are agreed upon, we will provide a detailed design illustration or 3D rendering for your approval. Modifications to the design can be made at this stage.
2.5 Production: After design approval and receipt of payment, we will commence the production process. Please note that the production timeline may vary depending on the complexity of the design and availability of materials.
3. Intellectual Property
3.1 Ownership: Evermade Design, LLC retains all rights, title, and interest in any intellectual property developed or created during the custom jewelry design process. This includes but is not limited to design process, concepts, drawings, illustrations, and 3D renderings.
3.2 Personal Use: Upon receipt of full payment, the custom jewelry piece becomes the property of the client and is for personal use only. The client may not reproduce, modify, or distribute the design or any related materials without obtaining prior written consent from Evermade Design, LLC.
4. Cancellations and Refunds
4.1 Cancellation: In the event that you wish to cancel your order during the design stage, please notify us as soon as possible. Depending on the stage of the design and production process, a cancellation fee may apply, which will be communicated to you.
4.2 Refunds: Due to the personalized nature of our custom jewelry, refunds are not provided once the design is approved and production has commenced. In exceptional cases, at our discretion, partial refunds may be considered.
5. Limitation of Liability
5.1 Warranty: We take pride in our craftsmanship and strive to provide high-quality custom jewelry pieces. However, we do not provide any warranty or guarantee, express or implied, regarding the suitability, durability, or performance of the jewelry.
5.2 Limitation of Liability: Evermade Design, LLC shall not be liable for any direct, indirect, incidental, consequential, or special damages arising out of or in connection with the use or inability to use our services, even if advised of the possibility of such damages.
5. Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of the state or country where Evermade Design, LLC is located.
6. Modifications
Evermade Design, LLC reserves the right to update or modify these Terms of Service at any time without prior notice. By continuing to use our services after any modifications, you agree to be bound by the updated Terms.
